I establish that by talking with the signer directly, not through a family member, and I ask the room to give us a moment if that is what it takes. Medication, fatigue, and a bad afternoon are all real, and if the signer cannot tell me in their own words what they are signing, I will come back another day rather than proceed. That is not me being difficult. A notarization obtained from someone who did not understand it is the one most likely to be challenged later, and a challenged power of attorney is worth nothing to the family relying on it.
Identification can be the practical snag in a facility. A current, unexpired, government-issued photo ID is the clean path, and a driver’s licence that lapsed while someone was in care is the most common problem I run into. A passport, a state non-driver ID, or a military or VA-issued photo card all work. If none of those exist, Pennsylvania allows identification through a credible witness who personally knows the signer and can themselves be identified, so call me before the appointment and we will sort out what is available rather than discovering the gap at the bedside.
